Richard Kent (LLB Hons) is a partner leading our Dispute Resolution and Litigation practice group located at our Boronia Office and also in the Melbourne CBD by appointment.
Experienced, practical, friendly and with a flair for the unusual, Richard believes that the key issue to delivering outcomes for clients is to develop a relationship with them and understand who they are, and where they come from. His approach to all matters is that you will achieve the best results for the client when they can provide instructions based on a full understanding of their legal position and the issues involved.
Richard’s practice focuses on disputes involving –
Commercial Disputes: disputes between business partners, directors liability, disputes under the Corporations Law, debt recovery and disputes relating to the supply of goods and services, breach of contract claims and claims relating to misleading and deceptive conduct;
Property and Land Interests: protection and recovery of interests in property, constructive trust and equitable claims, landlord and tenant disputes in relation to commercial and retail premises and disputes involving life tenants under the Settled Land Act 1958 (Vic);
Purchase / Sale of land disputes: claims relating to breach of contract and rescission concerning contracts for the sale of land;
Claims against Professional Advisers: claims against professional advisers such as a lawyers, accountants and financial advisers and claims involving insurers of professional advisers;
Banking and Finance: consumer credit law, enforcement of mortgages, guarantees and other securities, claims made to an External Dispute Resolution Service such as the Financial Ombudsman Service or Credit Ombudsman Service Limited;
Wills and Deceased Estates: Contested applications for Grants of Probate Letters of Administration, Intestacy, rights and duties of executors and administration of deceased estates, contesting a Will, Testator Family Maintenance claims (See our Q & A in relation to challenging wills here.)
Richard has considerable experience in litigation involving contested Wills and Testator Family Maintenance claims acting for both executors and beneficiaries as well as a significant commercial litigation.
He can also advise in relation to banking, mortgage & finance maters, in particular matters concerning consumer credit.
Richard has been involved in a wide range of litigation matters from relatively minor debts claims in the Magistrates’ Court to cases involving complex issues in the County Court, Supreme Court and Victorian Court of Appeal and the Federal Court.
